TERMS OF SERVICE

For inquiries regarding commissions, you may contact me at the following place: r0yalteeth @ Twitter or Tumblr (Please use notes/pm’s, I will not respond to general comments for commission inquiries.) This includes questions about commission progress as well. I will usually try to respond within 24 hours, but please give me at least 48 hours before messaging me again.
Currency:
1. I only accept payment in USD through PayPal. Any attempt to pay me in any other currency (i.e. cryptocurrency) will be denied.
Overview:
1. By commissioning me you are agreeing to abide by my terms of service. These terms may be changed at any time, but will not be effective retroactively. From here on out, the parties listed in these terms will be referred to as you/your/yours (the commissioner or customer), and me/my/mine (the artist, r0yalteeth).
2. Please be patient, I do have a full-time job and a social life outside of being an artist. If you haven’t heard from me in regards to your commission within a month of accepting, you may send me a note regarding the status of your commission.
3. You are paying for my service not the rights to my artwork.
4. References of some kind are required for all commissions (except for character designs, as these are specifically designed by me and are not to be confused with reference sheets). Reference sheets are highly preferred, but 2 flat-colored images that show all details and markings will be accepted as well. Please try to send multiple (non-conflicting) images, and a description, if necessary. I will not work off of description alone and do not accept shaded or NSFW references. The only exception to this is character designs or if the commission itself is NSFW.
Artist’s Rights:
1. I reserve the right to deny a commission for any reason (eg: heavy queue, subject matter, disrespect/harassment, etc.)
2. I reserve the right to work free from harassment. This includes, but is not limited to: general disrespect, attempts at bullying me into completing your art sooner, flirting/sexual advances, and unwanted RPing. All of these things will result in me cancelling your commission and refunding you (either in full, or in part, depending on amount I have completed).
3. I reserve the right to post all commissions and use them in my art portfolio and advertisements unless otherwise discussed. There will be a fee of $100 charged if I am to relinquish these rights.
4. I do not hold any right to reprint or resell any commission involving personal/original characters unless otherwise discussed. However, any commission that would be classified as fanart for a book/game/tv series/movie may be reprinted or resold (eg: as prints in an online store or at a booth at a convention) by me unless otherwise discussed (a fee may be charged here as well).
5. If the commission is cancelled, either by me or the commissioner, I have the right to repurpose the commission into a YCH.
6. My signature/watermark must remain on the image, no exceptions. Credit must also always be given.
7. Any edits to the finished artwork must be approved by me. You nor any other artist may not edit the image without my expressed permission.
8. I retain all rights to the artwork that I create. The commissioner may NOT submit any artwork into an AI bot or anything similar nor turn the piece into a NFT (Non-fungible token) or any other cryptocurrency related content. Doing so is a breach of contract and will result in legal action.
Commissioner’s Rights:
1. You have the right to terminate our agreement at any time, for any reason.
2. You are free to repost the artwork anywhere so long as full credit is given.
3. You have all rights to use the image for personal use, but to sell prints or use the image commercially, you must purchase the commercial rights. The price of the commercial rights will be negotiated on a case-by-case basis, but assume to pay at least an additional fee of +100% on top of the commission price.
4. You may not alter the artwork without my express permission (the only exception to this being to crop the art for use as an icon - credit must still be given). If a design needs to be altered slightly, please contact me! I am usually willing to update markings for you for a small fee.
5. You may not trace the artwork to create a base for others to color. Doing so will end with me blacklisting from future adopts and commissions.
6. You may request updates on your commission at any time, within reason. I may ask you to stop if I feel that you are asking too often. If you continue after I have issued a warning, I do retain the right to cancel your commission as stated in the artist’s rights section of this document.
Payments and Refunds:
1. Commissions of value $100 or lower must be paid in full before the commission is started. For commissions valued more than that, a payment plan can be discussed if needed. Half of the total cost will be required as a downpayment in these cases, and the rest being paid after a sketch has been approved.
2. Payment will only be accepted in USD at this time.
3. If you wish to cancel your commission, please send me a message saying so ASAP. A refund will be issued according to how much work has been completed. (eg: no work done will result in a full refund, sketch completed means I will keep 25%, linework means I will keep 50%, and flats means I will keep 75%. Anything after flats means that no refund will be given.)
4. Refunds will not be offered on completed commissions, adoptables, or in-stream/wing-it commissions. No exceptions.
5. If no work or contact has been made in 2 months, the commission will be cancelled and a full refund given. The only exception being that if I contact you about this and you still want the commission, we will discuss a course of action to getting your commission completed.
Time Taken, Deadlines, and Edits:
1. As stated in my overview, I do have a full-time job outside of my art, and I would appreciate if you would be patient with me.
2. My current turnaround time is typically 3-4 weeks, but may be completed sooner (or later) depending on a number of variables. (eg: queue size, job requirements, etc.) Your commission will be completed within 1 - 2 months after work begins. If a situation occurs that prevents me from working on it, I will provide you with an updated time of completion.
3. The completion date is entirely dependent on your communication with me. I will provide you with work in progress pictures, also called WIPs, at certain stages in the commission process depending on commission type (sketch, lineart, and flat colors). Please respond in a timely manner when I send you these, as I will require an approval from you before continuing. Exceptions to this will be with colored sketches, wing-its, and experimental art.
4. I work on things in my queue in order of when payment was made. However, if you absolutely must have a commission completed by a certain date (especially around holidays when I may potentially be busier), you must state as such from the beginning, as a rush fee will be charged to ensure that I can complete your commission in time. This fee will be decided on a case-by-case basis and is entirely dependent on how soon you need a commission completed (holidays and time frames that are much shorter than outlined in the TOS will be charged more).
5. I will not set deadlines/rushes without viable reason. A birthday or a holiday for example is acceptable, but, I will not rush to complete something just because you want it done before a specific date. My queue is in place for a reason.
6. I am willing to do edits during the sketch, lineart, and flat color stage so long as they are detailed in the reference sheet that I am given. Any major edits not specified in the reference sheet will be charged a fee. Free edits will not be made after the image is completed unless I missed a detail in the given reference sheet or it is paid for, and even then it may only be minor edits if edits are required.
7. Colored sketches and icons will only include one round of editing, as they are smaller pieces and will not require as many WIPs.
8. An edit required because of a mistake on my part will not be charged for . However, I ask that you try and catch these by the flat-coloring stage so I don’t have to alter the image too heavily later.
The code word is ➔ pupcakes.Subject Matter:
1. I do not sell NSFW art to minors under 18 years of age. If a minor lies about their age and tries to commission such, they will be blacklisted and blocked on all platforms. NO EXCEPTIONS!
2. While I do have a preference as to what I will/will not draw, I am not going to list these things here. Most subject matters already shown in my galleries are fair game to ask for as commissions. If you’re unsure if something you’d like drawn is on my list of what I will/will not draw, please don’t hesitate to note me!
3. I will not draw characters that are labelled with transphobic slurs. Examples include: Herm, futa, cuntboy, shemale, trap, etc. I, myself, am trans and I would appreciate if you don't use these words towards my art.
4. Some subject matters that I can easily say are not and will never be open to discussion are: Watersports, Scat, Vore, NSFW art of underage characters, AB/DL or babyfur art, and dubious-consensual (dub-con) or rape imagery.
Note: Asking for NSFW artwork of underage characters will result in the commissioner being blocked on all social media platforms and blacklisted from any and all commissions and adoptables. NO EXCEPTIONS!By commissioning me, you are stating that you have read and agreed to these terms.
